Last updated: 1 January 2025  ·  Effective date: 1 January 2025

At Sixth Sensation, your privacy is not a formality — it is a foundational commitment. Every commission we accept involves deeply personal stories, relationships, and memories. We treat this information with the same care and discretion we bring to the creative work itself. This Privacy Policy explains what data we collect, why, and how we protect it.

01
Who We Are

Sixth Sensation is a bespoke audio-visual creative studio based in Mumbai, India. We create original songs, cinematic AI films, and personalised poetry for individuals, families, and organisations worldwide.

For the purposes of data protection, Sixth Sensation is the data controller. If you have any questions about how your data is handled, contact us at contact@sixthsensation.com.

02
Information We Collect

We collect information in the following ways:

Information you provide directly:

  • Your name, contact details (email address, phone number), and location when you reach out to us or place a commission.
  • Creative brief content — including personal stories, descriptions of individuals, relationship details, life events, and any other information you choose to share to inform the Work.
  • Photographs, videos, and audio recordings submitted as part of a Brief or for use in AI film productions.
  • Payment information — we do not store full payment details. Payments are processed through secure third-party services.

Information collected automatically:

  • Basic website analytics — page visits, session duration, and device type — collected via Google Analytics or similar tools. This data is anonymised and aggregated.
  • IP address and browser type, collected by our hosting provider for security and performance purposes.
03
How We Use Your Information

We use your information exclusively for the following purposes:

  • To fulfil your commission — including writing, composing, producing, and delivering your requested Work.
  • To communicate with you about your commission — including sending drafts, revisions, delivery, and invoices.
  • To improve our services based on anonymised usage patterns from website analytics.
  • To comply with applicable legal obligations.

We will never: sell your personal information, use your stories or likeness in our marketing without your explicit written consent, share your Brief or personal details with any third party outside of our production collaborators, or use your data to send unsolicited marketing communications.

04
Legal Basis for Processing

We process your personal data on the following legal bases:

  • Contractual necessity — processing your Brief and contact details is necessary to fulfil your commission.
  • Legitimate interests — maintaining records of completed commissions for legal and accounting purposes.
  • Consent — where we request your permission to use excerpts of your Work for portfolio purposes. This consent is sought separately and may be withdrawn at any time.
  • Legal obligation — retaining financial records as required by Indian tax law.
05
How We Store & Protect Your Data

We take the security of your personal information seriously and implement industry-standard measures to protect it:

  • All digital files are stored on password-protected, encrypted devices and cloud storage services with two-factor authentication enabled.
  • Creative Brief materials — including photographs, videos, and written information — are stored in access-controlled folders and are not accessible to anyone outside the production team assigned to your commission.
  • Communications via WhatsApp and email are conducted over encrypted channels.
  • We do not store full payment card details. All payment processing is handled by trusted third-party payment providers.

Despite these measures, no method of transmission over the internet is 100% secure. We cannot guarantee absolute security, but we commit to notifying you promptly in the event of a data breach that affects your personal information.

06
Sharing of Information

We do not sell, rent, or trade your personal information. We may share limited information with the following categories of parties, solely for the purpose of fulfilling your commission:

  • Production collaborators — musicians, vocalists, sound engineers, or video editors who work under confidentiality agreements with Sixth Sensation.
  • Payment processors — to process your payment securely. These providers are not permitted to use your data for any other purpose.
  • Legal authorities — where required by law, court order, or legitimate governmental request.

Any collaborators who have access to your Brief are bound by confidentiality obligations equivalent to those described in this Policy and in our Terms and Conditions.

07
Your Rights

Depending on your location, you may have the following rights regarding your personal data:

  • Right of access — to request a copy of the personal data we hold about you.
  • Right to rectification — to request correction of inaccurate or incomplete data.
  • Right to erasure — to request deletion of your data, subject to our legal obligations to retain certain records.
  • Right to restrict processing — to request that we limit how we use your data.
  • Right to withdraw consent — where processing is based on consent, you may withdraw it at any time without affecting the lawfulness of prior processing.
  • Right to object — to object to processing based on legitimate interests.

To exercise any of these rights, contact us at contact@sixthsensation.com. We will respond within 30 calendar days.

08
Cookies & Website Data

Our website uses minimal, privacy-respecting analytics to understand how visitors use the site. We do not use intrusive tracking, advertising cookies, or sell browsing data to third parties.

Where analytics tools are used, data is anonymised and aggregated — we cannot identify you personally from this data. You may disable cookies in your browser settings at any time without affecting your ability to use this website.

09
Children's Privacy

Sixth Sensation's services are intended for adults aged 18 and over. We do not knowingly collect personal information from children under the age of 18.

Commissions may involve content created about children (such as a song for a child's birthday or a family film featuring minors). In such cases, the commissioning adult is responsible for ensuring appropriate consent has been obtained from all parties whose likeness or personal information is included in the Brief.

10
International Transfers

Sixth Sensation is based in India and primarily processes data within India. Where we use cloud storage, communication, or payment tools operated by international companies, your data may be processed in jurisdictions outside India.

We only use internationally recognised, reputable service providers with appropriate data protection standards. Where required, we ensure that suitable safeguards are in place for cross-border data transfers.

11
Retention of Data

We retain your personal data for as long as necessary to fulfil your commission and comply with our legal obligations:

  • Creative Brief materials, photographs, and videos — retained for 12 months after delivery, then securely deleted unless you request earlier deletion or consent to longer retention for portfolio purposes.
  • Financial and transactional records — retained for 7 years as required by Indian tax law.
  • General correspondence — retained for 3 years after the last communication, then deleted.

You may request early deletion of your creative materials at any time by contacting us, subject to our legal retention obligations.

12
Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. The updated date at the top of this page will reflect the most recent revision. We encourage you to review this Policy periodically.

For material changes that affect how we process your data, we will make reasonable efforts to notify you directly.
