These Terms and Conditions govern all commissions placed with Sixth Sensation, a bespoke audio-visual atelier based in Mumbai, India. By placing a commission, making a payment, or submitting a creative brief, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, please do not proceed with a commission.
In these Terms, the following definitions apply:
- "Sixth Sensation" refers to the bespoke audio-visual creative studio, its founder, and its authorised collaborators.
- "Client" refers to the individual or entity placing the commission and making payment.
- "Commission" refers to the agreed scope of creative work — including original songs, cinematic films, poems, or any audio-visual production — to be created by Sixth Sensation for the Client.
- "Brief" refers to the creative brief, questionnaire responses, photographs, videos, and any other information provided by the Client to facilitate the creation of the commissioned work.
- "Work" refers to the final delivered creative output produced by Sixth Sensation in fulfilment of the Commission.
- "Delivery Date" means the mutually agreed date by which the final Work will be delivered to the Client.
A commission is formally confirmed upon receipt of full or agreed partial payment. Until payment is received, no delivery date is guaranteed, no Brief will be reviewed, and no creative work will commence.
The Client is responsible for providing an accurate, complete Brief within the timeline agreed at the time of confirmation. Sixth Sensation reserves the right to adjust the delivery timeline if the Brief is submitted later than agreed.
Sixth Sensation accepts a limited number of commissions per month to preserve the quality and exclusivity of each Work. Availability is not guaranteed until a commission is formally confirmed by payment.
All prices are quoted in Indian Rupees (INR) unless otherwise specified in writing. International clients may be invoiced in USD, GBP, AED, or SGD at the prevailing exchange rate on the date of invoicing.
Payment terms are as follows:
- For commissions up to ₹60,000: full payment is required at the time of confirmation.
- For commissions above ₹60,000: a 50% advance is required at confirmation, with the remaining 50% due before final delivery.
- Payment methods accepted include bank transfer, UPI, and any other method confirmed in writing by Sixth Sensation.
All payments are non-refundable once creative work has commenced. The commencement of work is deemed to have occurred upon the earlier of: (a) Sixth Sensation beginning the drafting or production process, or (b) five calendar days after receipt of payment.
Given the bespoke, time-intensive, and exclusive nature of each commissioned Work, Sixth Sensation operates a strict no-refund policy once work has commenced.
No refund will be issued in the following circumstances:
- The Client changes their mind after payment has been made and work has begun.
- The Client expresses dissatisfaction with the style or aesthetic of the Work, provided it materially conforms to the submitted Brief.
- Delays caused by the Client's failure to submit the Brief, photographs, or other required materials on time.
- Circumstances beyond Sixth Sensation's reasonable control (force majeure).
If a commission is cancelled by the Client prior to any work commencing, Sixth Sensation may, at its discretion, offer a partial refund or credit towards a future commission. This is not guaranteed and will be assessed on a case-by-case basis.
If Sixth Sensation is unable to fulfil a confirmed commission for reasons within its control, a full refund will be issued promptly.
Each commission includes the following revision process:
- A first draft will be delivered to the Client two to three business days prior to the confirmed Delivery Date.
- The Client may request unlimited lyric and content revisions after receiving the first draft, at no additional cost.
- Revision requests must be submitted within 48 hours of receiving the draft. Requests submitted after this window may affect the Delivery Date.
- Once the Client approves the final version — or once the Delivery Date passes without written objection — the Work is considered delivered and accepted.
- No revisions will be accepted or entertained after final delivery.
Sixth Sensation will make every reasonable effort to accommodate creative feedback. However, fundamental changes to the musical style, language, or core concept of a commissioned Work — where such changes were not specified in the original Brief — may be treated as a new commission.
All Works created by Sixth Sensation are wholly original compositions created specifically for the commissioning Client.
Upon receipt of full payment and formal delivery of the Work:
- The Client receives a non-exclusive, perpetual, non-transferable personal licence to use the Work for personal, non-commercial purposes — including sharing on personal social media, use at private events, and personal video projects.
- The Client does not acquire ownership of the composition, master recording, or underlying copyright. Sixth Sensation retains full authorship, moral rights, and copyright in the Work.
- The Client may not commercially exploit, sell, license, sublicense, broadcast, or syndicate the Work without prior written consent from Sixth Sensation.
- Sixth Sensation reserves the right to use brief excerpts (not exceeding 30 seconds of audio or a single still frame) from commissioned Works for portfolio purposes — including social media, its website, and press materials — provided the Client has given prior written consent. This consent will be requested separately and is not assumed.
The Work is created exclusively for the commissioning Client and will never be replicated, resold, re-purposed, or licensed to any other client in any form.
Sixth Sensation treats all personal information, stories, photographs, videos, audio recordings, written briefs, and any other material provided by the Client as strictly confidential.
Sixth Sensation will not:
- Share, sell, distribute, or disclose the Client's personal information or creative brief to any third party.
- Reference, discuss, or describe the Client's commission publicly without explicit prior written consent.
- Use the Client's likeness, name, or personal details in any promotional material without explicit prior written consent.
All collaborators and contractors engaged by Sixth Sensation to assist with production are subject to equivalent confidentiality obligations.
This confidentiality obligation survives the completion of the commission indefinitely.
By placing a commission, the Client represents and warrants that:
- All information, photographs, videos, and materials provided in the Brief are either owned by the Client or used with the full permission of the relevant rights holders.
- The commission does not involve the creation of content that is defamatory, obscene, unlawful, or harmful to any individual or group.
- The Client is at least 18 years of age or has the consent of a legal guardian.
- The commissioned Work will not be used for any commercial purpose beyond what is expressly permitted in these Terms without prior written agreement.
Sixth Sensation reserves the right to decline or discontinue a commission at any time if it determines, in its sole discretion, that the Brief or intended use of the Work conflicts with these representations or its own ethical standards. In such cases, a pro-rata refund will be assessed based on work completed.
To the fullest extent permitted by applicable law, Sixth Sensation's total liability to the Client for any claim arising out of or in connection with a commission shall not exceed the total amount paid by the Client for that specific commission.
Sixth Sensation shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of profit, loss of goodwill, or emotional distress, arising from any commission — however caused.
Sixth Sensation does not guarantee that a commissioned Work will achieve any particular emotional response, artistic outcome, or practical result for the Client.
Sixth Sensation shall not be held liable for any delay or failure to deliver a commissioned Work resulting from circumstances beyond its reasonable control, including but not limited to illness, natural disasters, internet or power outages, acts of government, pandemic conditions, or any other event that materially prevents performance.
In such cases, Sixth Sensation will notify the Client promptly and make reasonable efforts to complete the commission as soon as practicable. If the delay exceeds 30 calendar days, the Client may request a full refund.
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with a commission shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.
Before initiating any formal dispute, the Client agrees to contact Sixth Sensation in good faith and allow a period of 14 calendar days for an attempt at amicable resolution.
Sixth Sensation reserves the right to update or modify these Terms at any time. Changes will be effective immediately upon publication on this website. The Terms applicable to a specific commission are those in effect at the time the commission is confirmed by payment.
Continued use of Sixth Sensation's services after any changes constitutes acceptance of the updated Terms.
